Regulations of Historic Cars
Art. 1
BMW AG, under the patronage of FIVA, organizes the "Concorso d’Eleganza Villa d’Este" International Concours d’Elegance for historic cars at the Grand Hotel Villa d’Este in close cooperation with Villa d’Este S.p.A.
Art. 2
The 25th – 28th April 2008 event is planned for cars of any type or marque built up to 1978 for which a FIVA Identity Card is issued applying to classes A-1, 2 or 3, or B-1, 2 or 3. The Concorso is to be staged in Cernobbio as detailed in the full programme supplied to entrants.
Art. 3
Cars shall be selected on the basis of their historic, technical and aesthetic interest, their rarity and authenticity, as well as the elegance and sophistication of their styling. The Executive Committee nevertheless reserves the right to accept cars which do not fully conform to these requirements on the basis of a particular interest in such cars. Should the Jury decide to award one of the available prizes to any of these cars, its decision must be justified. Prior to the final selection of entrants, candidates agree to have their car inspected by a representative of the
Executive Committee, subject to appointment.
Art. 4
Cars admitted to the Concorso must be in perfect running order at any time and, if required, provided with all necessary permits so as to be legally driven on the road. Roadgoing cars must have valid insurance and documentation as required by traffic law. All road trips shall, however, be made freely and individually and not in the form of an organized transfer.
Art. 5
The Executive Committee shall group the cars into classes according to reasonable criteria of similarity. The vehicles must line up on Saturday and Sunday in the areas provided for their class and will be presented as per FIVA Identity Card as class A-1, 2 and 3 or B-1, 2 and 3.
Art. 6
Cars shall be inspected and judged by the Jury during the mornings of Saturday and Sunday, as specified in the full programme. Entrants must be present alongside their car during the Jury’s inspection. If unable to attend, the entrant must nominate a representative to present the car during the Jury’s inspection. Cars which do not attend Saturday’s and Sunday’s Presentation will be excluded from the selection of the trophies and given trophies may be revised by the Organising Committee.
Art. 7
If necessary, the Concorso Jury may be divided into classes, each led by a Chairman, responsible for the compilation and presentation of the results. The Jury shall be assisted by a non-voting Jury Secretary. In the event of tied points scores between two or more cars, the President of the Jury, after consulting the Jury members, has decision-making powers to which there is no appeal, including the right to modify his/her own vote in the event of a tie. The Jury’s decisions are final and thus no appeals or objections may be presented after publication of the official results.
Art. 8
Along with the degree of originality, the state of conservation and/or the quality of any restoration work, the Jury shall pay specific attention to the following aspects: elegance and general sophistication of the styling, harmony of the colour schemes, elegance of the upholstery and fittings, elegance and conformity of the accessories, mechanical efficiency and conformity of the engine bay.
Convertible cars may be exhibited with their hoods lowered; the Jury may, however, ask to see the car with the hood correctly raised andfastened. The Jury is entitled to ask for the engine to be started. The Jury may also ask to sit in the cars to better evaluate the interiors.
Art. 9
Entrants (or their representative) may during the presentation provide the Jury with any relevant documentation regarding their car and its history which they believe to be useful in reaching an appropriate evaluation. In the case of unique or unusual features, adequate documentation confirming any variations or options with respect to the standard model should be provided. Non-original safety elements such as rear-view mirrors, seat belts or fire extinguishers etc. may be allowed on condition that their fitting does not compromise the originality of the car. The Jury shall penalize highly unusual colour schemes and non-original chrome, nickel, cadmium or other metal plating. Replaceable parts such as tyres, batteries, spark plugs and so on should conform as closely as possible to the original items.
Art. 10
Decals, sign-writing, sponsors’ logos or race numbers are not allowed except for sports cars with a racing background and clear historicalevidence of this. A club badge containing no general advertising – not even partial – and no larger than 10 x 10 cm may be placed on thecar.
Art. 11
Special awards voted by the Jury will be given to the winners on Saturday afternoon after the Parade.
Art. 12
The "Coppa d’Oro Villa d’Este" shall be awarded by secret ballot at Villa d’Este during the afternoon of Saturday. As guests of the event, the competing teams may participate in this vote by using the ballot provided in the entrant’s kit.
Art. 13
Class Winners and Prix d’Honneurs will be presented on Sunday afternoon after the Parade; there will be two prizes per class in the form of one Class Winner and one Prix d’Honneur.
Art. 14
The "BMW Italia Trophy" shall be awarded by public referendum at Villa Erba on Sunday. Teams associated with the competing cars may not participate in this vote, which is open only to the public gathered for the show.
Art. 15
The "BMW Group Trophy" shall be awarded to the "Best of Show" voted by the Jury and will be given to the winner during the gala dinner on Sunday evening.
Art. 16
Entries must be made using the appropriate form submitted together with all necessary documents and including a 3/4 front view photo for each car and team of maximum two persons (additional team members only on request). The completed application form together with a copy of the FIVA Identity Card must reach the Concorso d’Eleganza Villa d’Este Organising Committee, c/o Penta GmbH, POB 500251, 80972 Munich, Germany at the latest by 31st January 2008. The registration fee must be paid to BMW AG immediately after receiving the invoice. No refund is possible after confirmation. The entrant is responsible for his/her own travel and cancellation insurance.
Art. 17
With regard to hotel accommodation and meals, entrants may choose between packages A or B, both calculated for a team of maximum two persons. These packages do not include hotel extras, bar expenses, special upgrade requests and, in general, any expense not mentioned in the above packages.
Art. 18
The Organising Committee reserves the inalienable right to select entries. Rejected applications shall be notified as soon as possible. Given that the event is by invitation only, the Organising Committee will not normally accept substitutes for the cars or for the teams entered. Any request for substitution must be explicitly and formally approved up to six weeks before the start of the event.
Art. 19
Entrants and all other participants take part in the Concorso at their own risk. BMW AG, however, shall be liable for personal injury or death caused as a result of wilful intention or negligence on the part of BMW AG, its directors, corporate officers or agents. For any other damage, BMW AG shall be liable only to the degree that such damage has been caused as a result of wilful intention or gross negligence on the part of BMW AG, its directors, corporate officers or agents. This liability clause shall apply accordingly in favour of Villa d’Este S.p.A., its directors, corporate officers or agents.
Art. 20
These Regulations shall be governed by German law. Exclusive jurisdiction for all disputes arising out of or in connection with these Regulations or the Concorso shall be the Courts of Munich, Germany.
FIVA INTERNATIONAL TECHNICAL CODE RELEVANT FOR THE CONCORSO D’ELEGANZA VILLA D’ESTE
VEHICLE TECHNICAL CLASSIFICATION
VEHICLE DEFINITIONS:
Type A – STANDARD
A vehicle to standard specification as delivered by manufacturer. For vehicle preservation groups 1, 2 and 3, options, minor cosmetic changes and typical accessories available on the market in period are acceptable.
Type B – PERIOD MODIFIED (in first 15 years)
A vehicle specially built or modified in period for specific purpose, typical of its kind, and thus of historic interest in its own right. Solely in relation to Vehicle preservation group 1-3 the builder of such a vehicle is regarded as "maker".
VEHICLE PRESERVATION GROUPS:
Group 1 – AUTHENTIC
A vehicle as originally produced, unaltered and with little deterioration. Completely original, including interior and exterior finish; exceptions only for tyres, spark plugs, battery and other perishables.
Group 2 – ORIGINAL
A never restored vehicle, fully complying with original body and car maker specification. Mechanical parts subject to normal wear and tear may have been replaced with original parts from the period. Restoration of original paintwork, plating and upholstery are allowed.
Group 3 – RESTORED
A vehicle with known identity, wholly or partly dismantled, reconditioned and reassembled. Only minor deviations from maker’s specification in case of unavailability of parts or materials. Original manufacturer’s parts should be used where available, but may be replaced with others of the same specification; interior and exterior finish as close as possible to period specification.
